These Terms and Conditions (“Terms”) govern your access to and use of the Generative AI Swarm (GAS) Engine web application (“Application”), a workflow engine that utilizes generative AI and swarm intelligence, developed and operated by TK Technologies LLC, a company incorporated in the United States of America (“we,” “us,” or “our”).
By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Application.
The Application provides a user-friendly platform for businesses to leverage the power of generative AI. It enables users to:
You may need to create an account to access certain features of the Application. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activity that occurs under your account.
You may be able to upload, submit, store, or send content (“User Content”) through the Application. You retain all ownership rights to your User Content. However, by submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and translate your User Content for the purpose of operating and improving the Application.
The Application may integrate with or contain links to third-party services. Your use of such services is governed by the terms and conditions of those third parties.
The Application and all intellectual property rights associated with it (including, but not limited to, copyrights, trademarks, patents, and trade secrets) are owned by us or our licensors. You agree not to reproduce, modify, distribute, or create derivative works of the Application or its underlying intellectual property without our prior written consent.
THE APPLICATION IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND SECURITY. WE DO NOT WARRANT THAT THE APPLICATION WILL FUNCTION UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
We may terminate your access to the Application at any time, with or without cause. You may terminate your access by discontinuing your use of the Application.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States of America. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in New Jersey, United States of America.
These Terms constitute the entire agreement between you and us regarding your use of the Application and supersede all prior or contemporaneous communications and proposals, whether oral or written.
We may change these Terms at any time by posting the revised Terms on the Application. You are responsible for checking these Terms periodically. Your continued use of the Application following the posting of revised Terms will constitute your acceptance of the revised Terms.
